New rules of import of animals and animal products to Ukraine

On November 24 , 2019 the new rules for importing to Ukraine of live animals, reproductive material, food products of animal origin, feed, straw, hay and side products of animal origin and products thereof came into force.

Order of the Ministry of Agrarian Policy and Food #553 from 16.11.2018 replaces “Order 71” from June 14, 2004. The new rules were adopted with the aim to introduce systemic review and update requirements for imports, which did not meet modern realities of trade relations.

Major innovations are:

•            Ukraine now applies principles of zoning and compartmentalization (this complies with international practice of trade flexibility, when import of animals or products from zones or compartments, if not the entire territory of the exporting country is free from any animal disease, is allowed). As result, less diagnostic studies related to live animals will be required on the territory of the exporting country;

•             This document foresees reduction of the number of diagnostic tests of live animals to be conducted at the territory of exporting country. This will help reduce the costs of exporters and thus the price of imported animals for the Ukrainian farmers;

•             There has been change in the requirements for the origin of raw materials used in food production. According to the new rules, raw materials used in the processed food products should not originate exclusively from the territory of the exporting country, which is a significant relief for producers of food products;

•             Variety of products that can be imported to Ukraine has increased. Until now, the requirements for import of a number of product categories had not been defined which consituted a trade barrier. The new order introduces requirements for new categories of products such as: composite products, gelatin, collagen, colostrum, frog legs and snails, 33 categories of by-products and products of their processing and cultivation.

In addition to this, the State Service of Ukraine of Food Safety and Consumer Protection published a list of establishments per country which have supplied live animals and reproductive material during the previous five years. This list is permanently located here:

What does this mean for the exporters from the Netherlands?

  • All veterinary (health) certificates which were agreed bilaterally by the competent authorities of the Netherlands (or EU) and Ukraine remain valid.
  • In the due time, some of bilateral Dutch-Ukrainian certificates will be phased out by the new binding EU-Ukraine health certificates, or bilaterally agreed health certificates compiled in line with the new rules.

NB For export of live animals or genetic material it is important that the premises of the exporting company is in the register of premises that are allowed to export animals and genetic material to Ukraine that is published on page of the website of the SSUFSCP.

Products, live animals and genetic material, for which there are no bilaterally approved certificates.

  • Export of live animals or genetic materials from the Netherlands, for which there is no veterinary certificate bilaterally approved by the competent authorities of the exporting country and Ukraine.

NB For export of live animals or genetic material it is important that the premises of exporting company is in the list of companies that is in the register of premises that are allowed to export animals and genetic material to Ukraine that is published on page of the website of the SSUFSCP.

  • Export of food, feed and products of animal origin  to Ukraine, for which there are no bilaterally approved certificates, is possible with the model forms for import certificates published on the webpage of the State Service of Food Safety and Consumer Protection of Ukraine

Important is, that there should be no alterations in the layout or text of certificates that accompany shipments in comparison with the recommended models.

Export of products /live animals/genetic material, not listed in the Order 553,

is only possible with the certificate bilaterally approved by the competent authorities of the Netherlands (or EU) and Ukraine.
