Ukraine: changes in the Animal Feed Law

On December 2, 2020 Verkhovna Rada of Ukraine adopted the Law "On Amending the Final Provisions of the Law of Ukraine "On Safety and Hygiene of Feed" in Order to Stabilize the Feed Market" (No. 3672).  This is great news that shows that Ukraine takes steps to harmonize its legislation with that of the EU.

The law will allow use in Ukraine of feed additives in the production of feed for non-productive animals (pets), and import to Ukraine feed additives and feed made with feed additives without extra registration in Ukraine, if such feed additives are registered (approved for use) in the European Union. 

The same law obliges to indicate the name of the feed additive or its identification number (which are assigned in accordance with the legislation of Ukraine or the European Union) on the labeling of feed for non-productive animals within 5 years after the entry into force of the law.

As for the import of feed and feed additives for productive animals (cattle, pigs, poultry), the situation remains unchanged and still not very satisfying .

As for the feed which was registered in Ukraine before 2020, the law prescribes that within 4 years from the date of entry into force of the law, production, import (transfer) to the customs territory of Ukraine, circulation and use of ready-made feed, premixes and feed additives registered in accordance with the Law of Ukraine "On Veterinary Medicine" will be allowed, if on the date of entry into force of the law on Animal Feed, there was  a valid registration certificate issued for the respective ready-made feed, premixes or feed additives.

At the moment (January 2021), new feed or feed additives for non-productive animals are not yet allowed to be imported to the territory of Ukraine without registration in Ukraine, and registration in Ukraine of feed additives for productive animals  is not yet possible. Both procedures are in development. 

It is expected that procedures for importing of feed additives without registration as well as procedure for registration of feed additives will be in place in the coming months.
