Attention exporters of cut roses to Ukraine

Ukraine started official investigation against imports to Ukraine of fresh cut roses regardless of country of origin and export.

On May 22, 2020, the Interdepartmental Commission on International Trade, the Ukrainian authority in charge of imposing trade remedy measures, initiated safeguard investigation against imports to Ukraine of fresh cut roses (HS code  0603 11 00:  fresh roses suitable for bouquets or for decorative purposes). The investigation will be conducted by the Ministry of Economic Development, Trade and Agriculture of Ukraine. The investigation was initiated by the Ukrainian producer of roses Ascania Flora Ltd.

What does it mean for flower traders?

As a result of this investigation, the government may take the decision to introduce import quotas, increase import duties, or other special requirements for imports of the product in question. Such investigations may last up to three years, usually one year. Special safeguard measures may be introduced already during the investigation.

What can the companies do to advocate their interests?

This investigation concerns the interests of individuals and companies, both Ukrainian and foreign. They are entitled to submit the information which may be useful for the investigation to the Ministry of Economic Development, Trade and Agriculture of Ukraine. Such information will be taken into account by the Ministry only if it is confirmed by evidence, provided in the state language (Ukrainian), and is submitted within the established timeframe. It is also possible to submit evidence as confidential, which will be treated as confidential by the Ministry. The Ministry of Economic Development, Trade and Agriculture of Ukraine will be examining written comments and information as regards initiation of the above investigation within 45 days upon publication of this notification.

Traders, exporters, importers, market operators and export associations can register as interested parties to receive up-to-date information about the proceedings of investigation. The Ministry of Economic Development, Trade and Agriculture of Ukraine will be registering the interested parties of this investigation and examining hearing requests within 30 days upon publication of this notification.
