Regulatory Update: Upcoming Draft on Types of Products and Consumer Goods Mandatory to be Halal Certified

On 2 July 2021, the Indonesia Halal Product Assurance Organising Agency (BPJPH) notified the WTO (G/TBT/N/IDN/134) and proposed draft Decree regarding Types of Products and Consumer Goods Products Mandatory to be Halal Certified. The types of products and consumer goods are classified based on certain characteristics of each product, composition of their preparation materials and/or production processes. On 2 July 2021, the Indonesia Halal Product Assurance Organising Agency (BPJPH) notified the WTO (G/TBT/N/IDN/134) and proposed draft Decree regarding Types of Products and Consumer Goods Products Mandatory to be Halal Certified. The types of products and consumer goods are classified based on certain characteristics of each product, composition of their preparation materials and/or production processes.

The list of relevant products, including food & beverages are structured as follows and in the annexes for the details:

  • For food and beverage products, business may refer to Appendix I item (A) & item (B).
  • For processing services, including processing of food & beverage, business may refer to Appendix I item (J).
  • For storage services, including storage of food & beverage, business may refer to Appendix I item (K).
  • For packaging services, including packaging of food & beverage, business may refer to Appendix I item (L).
  • For distribution services, including distribution of food & beverage, business may refer to Appendix I item (M).
  • For sales services, including sales of food & beverage, business may refer to Appendix I item (N).

Important Note:

Classification of products that are not listed in this draft Decree will be determined by BPJPH upon coordinating with the relevant ministries and Indonesian Ulama Council (MUI). The Decree will come into force 6 months from the date of publication.

The comments deadline from WTO member countries will be on 31 August 2021.
