Important information for Dutch organizations that send humanitarian goods to Ukraine

From December 1, new procedure for customs clearance of humanitarian aid, as well as military and dual-use goods imported as humanitarian aid into Ukraine

Provision of Cabinet of Ministers of Ukraine #953 of 05.09.2023  (постанова від 05.09.2023 КМУ №953):

New procedure:

1. The IMPORTER generates a qualified electronic signature

2. The IMPORTER submits an electronic application for registration to the SYSTEM maintained by the Ministry of Social Policy

3. The SYSTEM automatically assigns the IMPORTER with a number in the system

4. The IMPORTER enters information about EACH batch of goods that he PLANS to import into the customs territory of Ukraine:

  • commodity group of the goods (HS Code)
  • quantity and weight of each product group;
  • percentage of depreciation  and shelf life;
  • a written offer from the DONOR (gift document) or an invoice;
  • letters from RECEPIENTS confirming the need for humanitarian aid;
  • PLAN for the distribution of humanitarian aid between FINAL RECEPIENTS.

5. The SYSTEM automatically assigns a UNIQUE code of humanitarian aid to such a list of goods - this is the fact that the goods are recognized as humanitarian aid for a period of 90 days

6. The IMPORTER or his representative (driver) submits a DECLARATION for customs clearance of such goods, which must contain the number of the IMPORTER in the system and the UNIQUE humanitarian aid code (in electronic form or in paper form at the customs border crossing point)

7. Submitting a declaration without a UNIQUE humanitarian aid code is NOT allowed

8. The import of humanitarian aid under the DECLARATION is allowed within 30 days from the date of its creation

9. The list of goods declared in the DECLARATION must correspond to the list of goods in the SYSTEM under the UNIQUE code (by categories and names of goods, number of seats, number of pieces and weight/volume)

10. If these data do not match, the customs official REFUSES to allow the cargo to enter the territory of Ukraine as humanitarian aid (the result is either a formal duplication of data without checking the goods, or a full inspection of the goods at the checkpoint)

11.The IMPORTER (state institution) within 15 days after the customs clearance of the goods forms in the SYSTEM (in its own electronic cabinet) an INVENTORY description of the humanitarian aid actually received - an internal primary document (act)

12. INVENTORY description of humanitarian aid consists of categories and names of goods, number of pieces and weight/volume, as well as (!!!) PRICE per unit of goods and ORIGINAL (fair) cost

13. If the ACTUALLY received humanitarian aid does not match the categories and names of goods, the number of seats, the number of pieces and the weight/volume specified in the DECLARATION, IMPORTER is obliged to create and submit an INVENTORY description of the actually received humanitarian aid in the SYSTEM, which IS NOTIFICATION to the authorities about such a discrepancy

14. The IMPORTER of humanitarian aid, by the 15th of the month following the month of customs clearance of the goods, submits a REPORT on the availability and distribution of humanitarian aid, which is created in the electronic cabinet of the SYSTEM or uploaded to the SYSTEM with the electronic signature of the IMPORTER

15. The REPORT contains information about each RECEPIENT of humanitarian aid (a legal entity), all FINAL RECEPIENTS (private persons), as well as the addresses (town, street, house) of EACH place of actual distribution of humanitarian aid

16. Declared humanitarian aid, for which a REPORT is not submitted within 90 days after customs clearance, is considered to have been used NOT for its intended purpose

17. The IMPORTER (except state institutions) loses the status of IMPORTER in case of failure to submit a REPORT within 90 days after customs clearance of goods

18. Re-registration of the IMPORTER is possible not earlier than in 6 months

19. CONTROL of TARGETED use is carried out by the National Social Service, tax and law enforcement services.

20. The monitoring of data on humanitarian aid and its distribution is carried out by the National Social Service
